Current legislation Essay

Outline current legislation, guidelines, policies and procedures within own UK Home Nation affecting the safeguarding of children and young people Current legislation is the result of The Children Act 1989 in England and Wales and in Northern Ireland the children (Northern Ireland) order 1995 which was brought in to ensure that all people who work with children worked together and that they were clear about their responsibilities and knew how to act if allegations of child abuse were made. Following the death of Victoria Climbie in the year 2000 an independent inquiry highlighted many problems with how reports of neglect and child abuse were dealt with and found that vulnerable people in society were not being safeguarded. The laming report in 2003 resulted in a green paper, Every Child Matters , which in turn lead to the Children Act 2004. The Children Act 2004 was introduced to make changes to the way the child protection system is structured and organised in England and wales. The every child matters paper is aimed at ensuring every child should be helped to have positive outcomes in life . They should: stay safe, enjoy and achieve, have economic wellbeing and make a positive contribution. The main points of The Children act 2004 was that every local authority has a director of children’s services who is ultimately responsible for ensuring that children are safeguarded. Local safeguarding boards were set up and children’s wishes taken into account. Children’s services now have a duty to safeguard children and to work together with a multi- agency approach to promote their welfare. The common assessment framework was introduced to identify children’s needs. Working together to safeguard children 2006 in 2006 the document was revised. This document had now updated the safeguarding and the national framework to help agencies work individually and together promote the welfare of children. In October 2009 the vetting and barring scheme was introduced, anyone working with children and vulnerable adults needs to have their personal information checked to prevent unsuitable people working in these areas. The scheme is now called the disclosure and barring service. CYP CORE 3.3 (1.2) Explain child protection within the wider concept of safeguarding children and young people Child protection is part of the wider work to safeguard and  promote the welfare of children and young people. We as practitioners and people working with children have a much wider role to play to ensure the safe and wellbeing of the children in our care. This refers to the activity that is undertaken to protect specific children who are suffering from any form of abuse or neglect. It also involves protecting children and young people from maltreatment and preventing impairment of a child’s health and development by ensuring children are raised in positive circumstances by providing safe and caring environments. Parents or carers who fail to protect or care for their children could then be taken to court and the child be then removed from the home and placed into care. Assessing observations to identify additional support needed by a child or young person will be a (CAF) which is a common assessment framework, this system enables multi agencies to access and add information about children. You must be careful that parental consent has been gained before sending this information to any agencies. The EYFS also highlights that there must be a designated person who will take the lead for all safeguarding. They are responsible for liaising with the local statutory children services agencies and also with the Local Safeguarding Children Board. They must provide support , advice and guidance to other members of staff and must attend a child protection course. Analyse how national and local guidelines, policies and procedures for safeguarding affect day to day work with children and young people It is our duty as practitioners working with children and young people to understand that we need to be aware and recognise any child at risk of harm and in need or is very vulnerable and unsecured. This earlier this is dealt with the better the outcome will be. There are clear lines of responsibility to ensure that all children are protected. Department for education – they have the overall responsibility for safeguarding and child protection in England Issue statutory and non-statutory guidance to local authorities Local Authorities – the y use guidance to produce procedures for services and practitioners Services used as basic for their policies and procedures I am also aware of my own settings safeguarding policy that was developed  with the Children Act 1989 and 2004 in mind. These are the policies and procedures we need to follow whilst working with children within our setting; Within childcare practice we must be aware that we have a clear and defined role in relation to child protection. Professionals working with children/young people such as teaching assistants, volunteers, outside agencies are all DBS cleared. Adults working with children should also be fully trained in safeguarding children by a nominated safeguarding adviser and have the opportunity to receive training in order to develop their understanding of the signs and indicators of abuse or neglect, this training is offered every 3 years. In order for child protection to work effectively we must ensure we have good inter relationships with other agencies and good cooperation from professionals that are competent in responding to child protection situations. A procedure for recording concerns and incidents if a child discloses information that concerns his/her welfare; we must make a record of exactly what the child has said in their words and report it to a safeguarding officer, ensuring that these records are kept confidentially and separated from their own record. Explain when and why inquires and serious cases reviews are required and how sharing of the findings informs practice A Serious Case Reviews are held when a child dies, abuse or Neglect are known or suspected to be a factor in the death, local organisations should consider immediately whether there are other children at risk of harm who require safeguarding. Thereafter, organisations should consider whether there are any lessons to be learnt about the ways in which they work together to safeguard and promote the welfare of children. Consequently, when a child dies in such circumstances, the Local Safeguarding Children Board (LSCB) should always conduct a Serious Case Review into the involvement with the child and family of organizations and professionals. The LSCB should always consider whether a Serious Case Review should be conducted: If a child sustains a potentially life-threatening injury or through abuse or neglect If a child has been subjected to Sexual Abuse If a child has been killed by a parent with a mental illness If they find  concerns about inter-agency working to protect children from harm The purpose of Serious Case Reviews carried out is to establish whether there are lessons to be learnt from the case about the way in which local professionals and organizations work together to safeguard and promote the welfare of children, identify clearly what those lessons are, how they will be acted on, and what is expected to change as a result. This will then improve inter-agency working and better safeguard and promote the welfare of the child. Where more than one LSCB has knowledge of a child, the LSCB for the area in which the child is or was normally resident should take lead responsibility for conducting any review. In the case of looked after children, the local authority which has responsibility for the child should take lead responsibility for conducting the review, again involving other LSCBs with an interest or involvement. Any professional may refer such a case to the LSCB if it is believed that there are important lessons for inter-agency working to be learned from the case. It would be the LSCB’s responsibility to take note of any referral and make a decision as to what if any action is needed. Explain how the processes used by own work setting or service comply with legislation that covers data protection, information handling and sharing In our setting all data for the children we look after is held in the main office. Only staff have access to this. The child’s personal information is stored away either on computer or on paper. The computers are all locked and you can only log on with a password which is unique to one person. All paper records are locked away in a cabinet. The information which we hold about the child includes the child’s name, date of birth, and contact number for parent/carer. In an event of a serious accident we would have this information available to us. In our own room the only information we hold about the child is their allergies information. We abide by the Data Protection Act as our setting also holds information about their staff and any safeguarding issues which we may be aware of. This information needs to be Acquired only when necessary Need to make sure that it is secure Make sure it is accurate All information is kept up to date We regularly remind parents to advise us of any changes such as address, telephone numbers or emergency contact details. We as staff are constantly reminded not to share any information on any child to another person or member of staff unless there is a safeguarding issue. We know who are safeguarding contact is and we should share any concerns straight away. We do not discuss any children’s matter outside of work with any one.

If you ask anybody what positive steps will you take to tackle climate change? Moreover everyone's answer would be â€Å"What will happen if only I start taking positive steps to tackle climate change? First let someone start then I will also start;† Friends this is wrong. To start anything the steps should be taken by us but we will wait till others start and others do the same. What's the first thing that comes in your mind when you hear about climate change? Answer is Global Warming or Rising Temperature.Global warming is one of the main reasons of climate change. Rising sea level, drought and Increasing temperature are the cause of climate change. And the one who suffers It are we and nature. And the main reason for it is human activities. What positive steps can you take to tackle climate change? There are many ways to do so like using renewable resources, using solar light, windmill, etc. The first way Is very simple and easy. The way Is traveling small distances by cycl e instead of scooter/car. These reduce the use of forest fuel like terror which is getting lesser and lesser day by day.We should also save petrol for future generations. We can also travel by public transport. Traveling by public transport could reduce the use of fuel by individual four or two wheelers. Some people feel uncomfortable in public transport. The recent launched car/bus by which run on hydrogen rather than petrol is also one way. The second thing I or we can do is save energy in the form of electricity. Day by day energy resources are getting scarce. The thing you or I can do is finish your work in daytime when there is natural eight given by sun, so there Is less use of artificial light.Another thing that we can do Is when there Is no need of electric appliances Like computer, bulbs, lights, fans, T. V. ‘s etc. Just don't forget to turn It off. Also In summer at night when you go to sleep Just open the windows rather than turning on the A. C. ‘s, so there I s natural air, electricity is conserved and pollution of air by A. C. Will not happen. The next boy is, to use 3 magical Or's. Reuse, Reduce and Recycle. They are the most common topics when we start talking about climate change. 1. ReuseReuse the thing which you have used once like plastic, bottles, plastic bags, glass bottles, etc. These are the materials which are very harmful to the climate. 2. By burning It very poisonous smoke is formed which can harm the climate and human beings. 3. Recycle After using the things once never throw It If It can be recycled. We can put things Like bottle in the bottle bank. NAS into save-a-can and give paper to the person who ND I can take is the one most people in the word have ignored. That is being vegetarian. Friends, at least we can be vegetarian we could reduce 51% of greenh ouse gases. The step is weird and simple but very powerful. Going vegetarian indirectly reduce deforestation. Non-vegetarian people are the cause of 1/3rd deforestation of grass in the word. They cut forest for grazing animals and to make them health in order to produce good meat. Meat industry produces more carbon dioxide then all word's cars and rare planes.Also being vegetarian could expand our fife by 15 years, and could protect us from diseases like Swine Flu and Bird Flu. In you and l, some people are farmers. So the next point is for them. People which are farmers amongst ‘us' should use. New methods of irrigation by which the use of water would become less and also should take interest in soil conservation for growing good crops and not letting a place become drought affected by making embankments, dress and forestation. So readers think that we should not wait for anyone to get on, instead we take a real step forward to save our mother planet.

There are many forms of communication by applying communication process model for example; â€Å"sender/receiver, encoding, decoding, message, channel, and feedback† (Cheesbro, O’Connor, and Rios, 2010). Learning to develop communication skills can help individuals to carry appropriate conversations and to interpret the connection with one another. There are many ways to communicate verbal and nonverbal for example, a parent tells his child how proud he is to be his parent and then gives him a hug, the parent expresses verbal communication by using positive words and applies nonverbal communication with a hug, body language. Individuals express verbal communication through oral or written skills. Verbal communication is the tone of voice that indicates how engaged the topic is and the ability to realize the emotions perceived. A person’s tempo in a conversation can be understood with the ideas being communicated. When sending a message in verbal communication the words accustomed to, can convey differently then how the receiver defines the context. Nonverbal communication is unstoppable and significantly valuable as much as speaking with a loud tone of voice and communicating verbally. In nonverbal communication, â€Å"All types of communication do not involve the exchange of words,† is defined as nonverbal communication† (Rogers Steinfatt, 1999, p. 67). A facial expression is the most common skill used in nonverbal communication for example; a smile or frown, eye contact, body language, and gestures. Overall, nonverbal communication can be effective positively and can be negatively ineffective in two different points of views. First example, husbands and wives communicate with each other by observing each other’s body language. This is a positive way of communication by effectively knowing each others thoughts. Second example, Children know as soon as their parents turn to look at them, the meaning is to stop misbehaving and could mean they are in trouble. The second example used is both effective and ineffective. Third example, a smile or frown can interpret a person to be happy or angry. The person could also be interpreted as approachable or would rather be left alone. This is positively effective and negatively ineffective. Fourth example, an individual waving or a hand shake in America, can be interrupted as a friendly sign or a strong individual but can also be interrupted as insulting and rude in other countries. This example is both effective and ineffective with positive and negative communication. However, verbal communication consequently has similar negatively ineffective as positively effective. First example, the lack of listening leads to misconception and when listening carefully the outcome becomes essential to the receiver. Both examples are ineffective and effective. Second example, is the choice of vocabulary and taking into consideration who will be receiving the information. This is used by effectively positive. Third example, the lack of verbal speech and failing to interpret the proper speech causes misunderstanding. In another way the proper use of speech can help the receiver to understand what is being interpreted. Example is used by ineffective with negative outcome but if used correctly can be effective with positive outcomes. Explain how demonstrative communication involves listening and responding. Listening and responding is used in demonstrative communication to engage the active communication skill from sender to receiver. This process is very important to both sender and receiver, by actively listening and ready to respond. One example is a sender and receiver must be willing to communicate properly. â€Å"Accurate listening efficiency promotes retention of important information, resulting in fewer misunderstandings and on-the-job errors† (Wilson, n.d., p. 1). Once a sender is ready to send out a message it is important for the receiver to receive the correct information by evaluating the message sent, this way the receiver can respond back with feedback and a solution. Applying the steps in the communication process model, mentioned in the first paragraph of this essay will go hand in hand with the practice of listening and responding which will help by demonstrating communication through the steps being practice. An example of listening and responding with children is, â€Å"monkey see monkey do† (Uebergang, 2006, Dec.20). Listening and responding is a process to be learned as individuals who continues to repeat the process with a good attitude. Conclusion Communicating can never be avoided no matter how hard we try and cannot solve every issue. Demonstrative communicate is an ongoing process of how we interact within one another every day, in different settings of environment such as professional, at home, work, and community. Stakeholder benefits from sustainable tourism Sustainable Tourism Development Objective The aim of this assignment is to; To discuss how stakeholders can benefit from planning of tourism developments as well as to converse the benefits and weaknesses of public/private sector tourismplanning partnerships by referencing to a current example. To evaluate the different approaches to tourism planning and development by considering its features, the significanceofinteractive planning systemsand processes in tourism developments and the types of approaches available to measure tourist impacts To assess the need for planningfor sustainable tourism by considering the factors that may hinder it and to inspect the different stages in planning for sustainability. To analyse the different issues related to tourism development planning by looking at the implications of balancing supply and demand, the moral and ethical issues of enclave tourism as well as the methods of resolving a conflict of interest. To investigate the socio- cultural, environmentaland economic impacts of tourismin developing countries and emerging destinations Methodology The information in this project was obtained by the lectures, textbooks and the World Wide Web. For the completion of this project the consultant has decided to use both methods of primary and secondary information. Primary information is one of the best ways to collect first hand information this information will be collected by asking question via questionnaires, interviews and surveys. To arrive at a completion the consultant had to make a decision that secondary information will be necessary in the Researching of the information. So in order to collect the secondary information the consultant has decided to use magazines, book, blog and the internet. This will help in planning and the development of tourism. Rationale This project was formed from a case about two companies A Consultation company and a small business. The tourism development in Jamaica and the Ministry of tourism that is using a consultant company in the development and planning of tourism. The project will focus on the influx in the Spanish hotels that have been invested in Jamaica that are serious concern that Jamaica is heading in an unsustainable direction as it relates to the tourism industry and its development. In this project you will notice how the stakeholders can benefit from planning of tourism, the discussion of the advantages of public and private sectors tourism planning partnerships drawing on a current example. The analyzing the tourism development and planning at different levels of the evaluation of the significance of the interactive planning system and processes in the tourism developments. The factors that may prevent and obstruct sustainable tourism will also be analyzed, also the different stages in planning for sustainability. The moral and ethical issues of enclave tourism will be evaluated. Literature Review What is Sustainable tourism? â€Å"Tourism that takes full account of its current and future economic, social and environmental impacts, addressing the needs of visitors, the industry, the environment and host communities.† According to The Institute of International Auditors/Global (2011) â€Å"Public sectors consist of government and all publicly controlled or publicly funded agencies, enterprises and other entities that deliver public programs, goods or services. It is not, however always clear whether any particular organization should be included under the umbrella.â€Å"Stakeholder is a process is actors (persons or organization) with a vested interest in the policy begin promoted. These stakeholders, or â€Å"interested parties,† can usually be grouped into the following categories: international/donors, national political (legislators, governors), public (ministry of health, social security agency, ministry of finance), labour (unions medical associations), commercial/private for profit, non profit (nongovernmental organizations foundations), civil society and users/ consumers.† Was define by Kammi Schmeer (1999). World tourism organization stated that the tourism is a social cultural and economic phenomenon which entails the movement of the people to countries or places that are outside their usual environment for personal or business purposes. These people are called visitors and tourism has to do with their activities, some of which imply tourism expenditure. This maybe tourist or excursionists, residents or non residents. Task 1.1 Discuss how stakeholders can benefit from planning of tourism developments with reference to a current case study. Tourism can deliver short andlong term economic, environmental and socio-cultural effects on a destination. Careful consideration needs to be given to the decisions made throughout the planning process, and thereare many advantages, and disadvantages, of involving a broad range ofstakeholders during the decision-making process, if medium and long-term oriented, understand that their capital is not only their investment andinfrastructures, but also the natural and cultural environment. Therefore, theystart considering tourism development in a more sustainable way. 1.2 Discuss the advantages and disadvantages of public/private sector tourism planning partnerships drawing on a current example In the tourism industry, there are examples where partnership arrangements are highly effective for the success of tourism planning and development. Since the public sector is concerned with the provision of services, the resolving of land-use conflicts and the formulation and implementation of development policies, and the private sector is mainly concerned with profit, partnerships between the private and public sector on various issues can benefit destinations. Task 2.1 Analyze features of tourism development planning at different levels. There are three types of different levels in tourism development: International level Tourism planning at the international level involves more than one country and includes areas such as international transportation services, joint tourism marketing, regional tourism polices and standards, cooperation between sectors of member countries, and other cooperative concerns. ƒ National level Tourism planning at the national level is concerned with national tourism policy, structure planning, transportation networks within the country, major tourism attractions, national level facility and service standards, investment policy, tourism education and training, and marketing of tourism. ƒ Regional level – Tourism planning at the regional level generally is done by provinces, states, or prefectures involving regional policy and infrastructure planning, regional access and transportation network, and other related functions at the regional level. 2.2 Evaluate the significance of interactive planning systems and processes in tourism developments. This is because interactive planning is focused in systems thinking and is based on the belief that an organization’s future depends at least as much on what it does between now and then, as on what is done to it. The organization will then create its future by continuously closing the gap between its current state and its desirable current state. Interactive planning has three unique characteristics: Interactive planning works backwards from where an organizationwantsto be now to where itisnow. Interactive planning is continuous; it does not start and stop. Interactive planning lets the organization’s stakeholders to be involved in the planning process. 2.3 Evaluate the different methods available to measure tourist impacts. The analysis of socio-ecological tourism-based systems requires new, qualitatively different evaluation schemes that enable an integrated assessment of ecological, social, and economic factors through the use of appropriate indicators related to the ecosystem service concept. People, indeed, begin to understand more clearly that human societies are dependent on the ‘services’’ and ‘‘functions’’ provided by the earth’s physical, chemical and biological systems. Ecosystem services include the production of goods (seafood, timber, and precursor to many industrial and pharmaceutical products), basic life-support processes (pollination, water purification, and climate regulation), life-fulfilling conditions (serenity, beauty, and cultural inspiration), preservation of options (conserving genetic and species diversity for future use), and the assimilation of waste products (Daily, 1997). Nature-based tourism is strongly dependent on the quality of the environment more than any other form of tourism. Even eco-tourism, however benign it may be, will have some impacts on the environment (see e.g. Modelling socio-ecological tourism-based systems for sustainability), and therefore it requires management and control like any other resource exploitation activity. The amount by which resources are exploited is a critical tourism parameter because tourism must satisfy two constraints at the same time. First, ecological quality and integrity ofresources must be maintained, to make sure they remain attractive to tourists as well as to residents (see e.g. Indicating fragility of socio-ecological tourism-based systems). Second, the quality of recreational experience by tourists also must be maintained, and this is based not only on the quality of natural environment, but also on the levels and the nature of interactions between groups of users and residents and their perception of environmental quality Task 3.1 Justify the introduction of the concept of sustainability in tourism development. The tourism planners have started to rethink the objectives for the development of the industry as a result of three factors: The tourist is changing, wishing for greater involvement with local people and many are conscious of the economic, social and environmental impact of their visit. They seek an integrated experience involving multiple activities so that the interaction with community increases Local communities are becoming sensitive to the effect tourism is having on their lifestyles, culture, and the environment and can resent its intrusion. A tourism enterprise that meets these three principles will â€Å"do well by doing well†. This means running a tourism business in such a way that it doesn’t destroy natural, cultural, or economic resources, but rather encourages an appreciation of the very resources that tourism is dependent on. A business that is run on these three principles can enhance conservation of natural resources, bring appreciation to cultural values, and bring revenue into the community and be profitable. 3.2 Analyze factors that may prevent/hinder sustainable tourism. The factor that prevents/ hinders sustainable tourism in a country is politics that have to with the acquisition of power, allocation or resources and administration of public affairs. Political Ideologies, Distribution of Wealth, Changing Class Boundaries, Natural and Manmade disaster. Tourism challenges such as religions, Social structures, Employment and Seasonal Fickle and Fragmentation also Regional Economic Problems. 3.3 Analyze different stages in planning for sustainability Task 4 Evaluate methods of resolving a conflict of interest to ensure the future well-being of a developing tourism destination 4.2 Analyze the implications of balancing supply and demand 4.3 Evaluate the moral and ethical issues of enclave tourism Task 5 Compare current issues associated with tourism development in a developing country and an emerging destination where the impacts of tourism are different. Recommendation Conclusion Tourism development has both positive and negative effects on a tourism destination. Communities are very often threatened with unwanted developments and face problems from unplanned or carelessly planned tourism expansion. In order to overcome these multi-faceted problems, comprehensive tourism planning is needed to maximise the benefits and minimise the costs or disadvantages of tourism development through the involvement of the local community who have to live with the tourists and the costs and benefits they bring. The above literature review indicates that although there is a strong argument for the need for planning in tourism development. However, it is not important only to design a development plan but also to implement it. Therefore, it is necessary to develop policies that will be widely accepted by the local community. Planners and governments should consider the fact that there are limits to how much tourism a particular destination could absorb. Destinations need to consider these limits and plan their tourist industry accordingly. Planners and governments must continuously measure environmental and socio-economic impacts of tourism, in Order to ensure long-term benefits for residents and tourists alike without damaging the man-made and natural environment. Tourism has been seen by many governments as an economic development Strategy and if a destination area wishes to maintain tourism as a long-term Activity, it should be concerned through planning to differentiate its product from Competing destinations through better preservation of its environment and culture, understanding the needs and desires of the local community and increased Awareness in the community as to what the industry means in terms of costs and benefits.
